FOIA Records Service Agreement

1. Acceptance of Agreement

By checking the box "I have read and agree to the Terms of Service" and clicking "Pay and Continue," you (the "Client") expressly and unambiguously accept the terms of this Agreement. TerraImm will record the date, time, IP address, and version of the document accepted as evidence of such consent.

2. Description of Service

TerraImm Inc. ("TerraImm," "we," "us") will prepare, review, file, and track a request under the Freedom of Information Act (FOIA) with U.S. Citizenship and Immigration Services (USCIS) to obtain a copy of your immigration records (such as your A-File), on your behalf and with your written authorization (USCIS Form G-639 or other applicable consent document).

The Service is considered completed when TerraImm files the FOIA request with USCIS and provides the Client with confirmation of filing (acknowledgment/tracking number). TerraImm does not control or guarantee USCIS response times, approval, or the content of any records USCIS may choose to release (see Section 6).

3. Legal Nature of Service (Not a Law Firm)

TerraImm Inc. is an administrative service provider and is not a law firm. This service does not constitute legal advice, legal representation, or immigration consulting. Using this service does not create an attorney-client relationship. If you require legal representation or advice regarding your immigration status, you must consult a licensed immigration attorney.

4. Fees and Payment Policy

The total fee for the FOIA Records Service is $350 USD (one-time flat fee), payable in full before service initiation via our payment processor, Stripe. This fee covers TerraImm's administrative, preparation, and tracking services.

Refund policy: The Client has a 24-hour grace period from the time of payment to request a full refund by contacting info@terraimm.com. Once this window has elapsed, the fee shall become final and non-refundable, regardless of the status or outcome of USCIS processing, and regardless of whether the required authorization (Form G-639 or other applicable consent document) has been executed by that time.

TerraImm does not store or process your credit card details directly; these are handled exclusively by Stripe in accordance with its own policies.

5. Client Obligations

To complete your request, you agree to:

• Provide accurate, complete, and truthful personal information (including full legal name, alias, date of birth, mailing address, and Alien Registration Number/A-Number, if applicable).
• Sign and execute the required authorization documents.
• Confirm that you are the subject of the requested record, or that you hold the legal authority required to request it on behalf of a third party.

TerraImm is not liable for delays, rejections, or errors caused by incomplete or inaccurate information provided by the Client.

6. Government Processing and Results

USCIS processing times are entirely outside TerraImm's control. We do not guarantee specific response times, approval, or the complete release of records by USCIS.

7. Privacy and Data Handling

TerraImm collects and processes sensitive personal data (including A-Number, date of birth, and other immigration-related information) solely for the purpose of preparing and filing your FOIA request. Use of this information is governed by our Privacy Policy, which is incorporated into and forms part of this Agreement. TerraImm will not sell or share this information with third parties except as strictly necessary to provide the Service (e.g., submission to USCIS) or as required by law.

8. Limitation of Liability

To the maximum extent permitted by law, TerraImm's total liability to the Client for any claim arising out of this Agreement is limited to the amount actually paid for the Service. TerraImm shall not be liable for indirect, incidental, consequential, or punitive damages.

9. Modifications to the Agreement

TerraImm may update these Terms at any time. Changes will be communicated by posting on our website and/or by email to the address on file. Continued use of the Service after such notice constitutes acceptance of the updated terms.

10. Dispute Resolution

Before initiating any legal action, the parties will attempt to resolve any dispute through good-faith direct negotiation, with written notice to the other party at least 30 days in advance.

11. Governing Law and Jurisdiction

This Agreement is governed by the laws of the State of Texas. Any legal dispute shall be resolved exclusively in the state or federal courts located in Harris County, Texas.
